EliteFans.ai — DMCA Takedown Policy

Introduction

EliteFans.ai (“EliteFans,” “we,” “us,” or “our”) respects the intellectual property rights of copyright holders and expects users of the platform to do the same. This Digital Millennium Copyright Act (“DMCA”) Takedown Policy explains how copyright owners or their authorized agents may submit notifications of alleged copyright infringement related to content hosted on the EliteFans.ai platform.

This policy applies only to content hosted on EliteFans.ai. If you need assistance with content appearing on other websites, please contact the operator of those platforms directly.

 

DMCA Notice & Takedown Policy

Although EliteFans.ai may operate globally, we voluntarily comply with the Notice and Takedown provisions of the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512.

EliteFans.ai qualifies as a “Service Provider” under 17 U.S.C. § 512(k)(1) and is entitled to the safe-harbor protections provided under the DMCA. We respond expeditiously to valid notices of alleged copyright infringement and take appropriate action, including removal or disabling of access to infringing material and termination of repeat infringers where warranted.

 

Notice of Claimed Copyright Infringement

If you believe that copyrighted material you own or control has been posted on EliteFans.ai without authorization, you may submit a DMCA Notice to our Designated Copyright Agent.
Your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the allegedly infringing material, including the specific URL(s) where the material is located on EliteFans.ai
  4. Your contact information, including name, address, telephone number, and email address
  5. A statement of good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement under penalty of perjury that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf

Abuse of DMCA Process

Submitting false or misleading DMCA notices or counter-notifications may result in legal liability under 17 U.S.C. § 512(f), including damages, court costs, and attorneys’ fees.

EliteFans.ai will investigate and take action against users who abuse the DMCA process. These procedures apply only to copyright infringement claims and not to other disputes or policy violations.

 

Takedown Procedure

Upon receipt of a valid DMCA Notice:

  1. EliteFans.ai will expeditiously remove or disable access to the allegedly infringing content
  2. The affected user will be notified of the removal
  3. The user may submit a counter-notification if they believe the removal was the result of mistake or misidentification

EliteFans.ai reserves the right to terminate accounts of repeat copyright infringers in appropriate circumstances.

 

DMCA Counter-Notification Procedure

If you believe content was removed in error, you may submit a counter-notification pursuant to 17 U.S.C. § 512(g). Your counter-notification must include:

  1. Identification of the material that was removed and its original location (URL)
  2. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification
    • Suggested wording:
      “I swear, under penalty of perjury, that I have a good-faith belief that the referenced material was removed or disabled as a result of mistake or misidentification.”
  1. Your name, physical address, telephone number, and email address
  2. A statement consenting to jurisdiction of the appropriate U.S. Federal District Court and agreeing to accept service of process from the original complainant

All DMCA notices and counter-notifications must be submitted in English. Submissions in other languages may be deemed non-compliant.

 

Restoration of Content

Upon receipt of a valid counter-notification, EliteFans.ai will forward it to the original claimant.
Unless we receive notice that the claimant has filed a court action seeking an injunction, the removed content may be restored within 10–14 business days.

 

Policy Modifications

EliteFans.ai reserves the right to modify or update this DMCA Policy at any time. Users are encouraged to review this policy periodically for changes.
