EliteFans.ai — 18 U.S.C. §2257 & §2257A Disclosure Statement

Introduction

EliteFans.ai (“EliteFans,” “the Website,” or “the Company”) operates an online, subscription-based platform that allows verified creators to upload user-generated content. Although EliteFans.ai may not be based in the United States, the Company voluntarily complies, where applicable, with the record-keeping requirements of 18 U.S.C. §§ 2257 and 2257A and 28 C.F.R. Part 75 (“Section 2257”) for content accessible within the United States.

 

Compliant Content

All individuals appearing in any visual depiction of actual or simulated sexually explicit conduct appearing on, or otherwise contained within, EliteFans.ai were eighteen (18) years of age or older at the time the content was produced.

EliteFans.ai requires creators to complete identity verification, age verification, and payment verification prior to uploading content. Records required by 18 U.S.C. §2257, 18 U.S.C. §2257A, and 28 C.F.R. Part 75, et seq., are maintained by the appropriate Records Custodian in accordance with applicable law.

 

Exempt Content

Certain visual depictions available on EliteFans.ai are exempt from the provisions of Section 2257 because:

  • They do not depict conduct defined in 18 U.S.C. §2256(2)(A)(i)–(iv); or
  • They do not depict conduct regulated under 18 U.S.C. §2257A produced after March 19, 2009; or
  • They do not depict conduct defined in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; or
  • The visual depictions were created prior to July 3, 1995; or
  • EliteFans.ai does not act as the primary producer of such exempt material, as defined in 28 C.F.R. §75.1(c).

 

Producer Status

With respect to user-generated content, individual creators are the primary producers of the content they upload. EliteFans.ai acts solely as a secondary producer and service provider, as defined under 28 C.F.R. §75.1, by hosting and distributing content submitted by verified users.
